Terms & Conditions
Rates effective September 1, 2026.
Definitions
Standard Sessions: Tutoring billed month-to-month with no long-term prepaid commitment.
Larger Contracted Engagements: Tutoring booked by a single Parent/Guardian account at four (4) or more hours per week, or otherwise designated by Teton Tutors L3C as bundled/extended; subject to booking fee, lock-in, and written-confirmation rules herein. Tutoring hours booked across siblings count toward the same threshold. Classes, clubs, and hours included in a Membership do not count toward this threshold and are governed by their own sections.
Clubs & Classes: Multi-student programs with minimum enrollment, billed per the "Clubs/Classes" section.
Membership: Enrollment in a RadAcad or Independent membership program, billed monthly or by semester per the "Memberships" section.
House Call: Any session where the tutor travels to the student's home or another location requested by the Parent/Guardian, rather than meeting at a Teton Tutors or RadAcad location. Sessions held at the Jackson branch of the Teton County Library are not House Calls and are billed at standard rates.
Premium Services: House calls, standardized test preparation (including ACT, SAT, and similar exams), and other services designated by Teton Tutors L3C as premium.
Sickness: Illness preventing attendance (e.g., fever/contagious condition/doctor-verified illness) or a condition that would reasonably require absence from school.
Emergency: Unforeseen, significant circumstances beyond the family's control, including hospitalization/serious injury of the student or immediate family member, death in the immediate family, natural disasters/severe weather rendering attendance unsafe, or other circumstances Teton Tutors L3C deems a legitimate emergency.
Tutor Fault: Teton Tutors L3C or its subcontracted tutor is unable to deliver contracted services due to illness, unavailability, scheduling error, or other causes attributable to Teton Tutors L3C.
Fees Payable to Teton Tutors L3C
Standard Tutoring and Test Preparation Sessions
The Parent/Guardian will pay Teton Tutors L3C the following hourly rates:
Standard sessions One student: $185 per hour Two students: $147 per student per hour Three students: $130 per student per hour Four or more students: $115 per student per hour
Sessions including Premium Services One student: $235 per hour Two students: $200 per student per hour Three students: $180 per student per hour Four or more students: $163 per student per hour
Premium rates apply to the full session when any Premium Service is included. Group rates are determined by the number of students scheduled for the session; if group size changes, the applicable rate may be adjusted accordingly.
RadAcad full members receive 15% off all tutoring rates. Membership discounts apply only while the membership is active and in good standing. The membership discount is separate from financial aid, which applies to membership fees only.
No changes to the Fee may be made except by written agreement of the parties listed herein. The Parent/Guardian shall not negotiate a different Fee with subcontracted tutors or club leaders.
Note: Billing, cancellation, and refund rules for Memberships, Larger Contracted Engagements, and Clubs & Classes are governed by their respective sections and supersede Standard Session policies where they differ.
Late Payments
A late fee of $50 will be applied to any invoice that remains unpaid fifteen (15) days after its due date. This applies to all invoices, including tutoring, memberships, classes, and clubs.
Teton Tutors L3C may waive a late fee at its discretion. Continued non-payment may result in suspension of services under the Termination section.
Memberships
Rates. Membership rates are as published by Teton Tutors L3C and provided in writing at the time of enrollment. Rates may be adjusted with thirty (30) days' written notice.
Billing. Memberships are billed monthly in advance, or by semester where a semester commitment has been made. The fall semester is billed as four (4) monthly units; the spring semester is billed as five and one-half (5.5) monthly units.
Payment. Tuition payments are due on the 15th of each month, and are subject to the Late Payments section above.
What is included. Membership includes access to the RadAcad program as described in the Parent/Guardian's enrollment documents. Classes, clubs, and tutoring beyond what the membership specifies are billed separately at the applicable rate, less any membership discount.
Discounts. Families who commit to and pay for a full semester receive 5% off that semester, with payment due September 1 for the fall semester and January 1 for the spring semester. Families who pay earlier — by July 1 for the fall semester or November 1 for the spring semester — receive an early-bird discount of 7% off that semester.
Prepayment discounts are contingent on payment being received by the stated deadline and on the family completing the full commitment period. A family who withdraws before the end of a prepaid period forfeits the discount, and any refund will be calculated at the undiscounted rate for the period actually used.
Financial Aid. Need-based financial aid is available to RadAcad families, based on household income relative to Median Family Income (MFI) for Teton County:
Families at 100–120% of MFI: 10% off Families at 80–100% of MFI: 20% off
Financial aid applies to RadAcad memberships only. It does not apply to tutoring, classes, after-school clubs, or any other Teton Tutors L3C service. Where financial aid and a prepayment discount both apply, they are applied sequentially. Financial aid is awarded at the discretion of Teton Tutors L3C and may require documentation of household income.
Cancellation. The Parent/Guardian may cancel a monthly membership with thirty (30) days' written notice. This applies year-round, including summer programs. Membership costs for the current month will not be prorated.
Semester commitments. Families who have committed to a full semester remain responsible for the full semester, except in the case of documented Sickness, Emergency, or fault on the part of Teton Tutors L3C. Where a refund is due, it will be calculated on the unused portion at the undiscounted rate.
Missed days. Membership fees are not reduced, credited, or refunded for days a student does not attend, including for travel, illness, or scheduling conflicts. Membership reserves the student's place in the program regardless of attendance.
Larger Contracted Engagements
From time to time, Parent/Guardian may request extended tutoring services from Teton Tutors L3C at four (4) or more hours per week, or otherwise designated by Teton Tutors L3C as a "Larger Contracted Engagement." These engagements are subject to the following terms:
Lock-In Period: Beginning thirty (30) days prior to the scheduled start date of services, the engagement becomes fully binding. At this point, the Parent/Guardian remains responsible for the contracted hours regardless of attendance or discretionary cancellation, except in the case of documented Sickness, Emergency, or Tutor Fault.
Booking Fee: A 10% booking fee/deposit will be invoiced upon confirmation of services. This booking fee is non-refundable but will be credited toward the final invoice once all terms of the engagement have been fulfilled by the Parent/Guardian, including completion of the agreed-upon hours unless otherwise modified in writing prior to the lock-in period. If the Parent/Guardian does not complete the contracted hours for reasons other than documented Sickness or Emergency, the booking fee will be retained by Teton Tutors L3C as liquidated damages. If Teton Tutors L3C or its subcontracted tutors are unable to deliver the contracted services due to Tutor Fault, the booking fee will be refunded or proportionally credited.
Payment: Larger Contracted Engagements are invoiced in advance of services. Apart from the booking fee, which is invoiced upon confirmation, the engagement will be invoiced thirty (30) days prior to the scheduled start date, or at the time of booking where the engagement is booked within thirty (30) days of the start date. Teton Tutors L3C may invoice the full engagement up front, by month, or in installments, and will confirm the billing schedule in writing at the time of booking. Amounts paid in advance for hours not yet delivered will be refunded or credited where cancellation is due to documented Sickness, Emergency, or Tutor Fault. Otherwise, amounts paid in advance are non-refundable.
Hours Requested: Hours requested and confirmed in writing — including email, text message, calendar invite, or other written communication — shall be considered binding commitments under this section. These hours will be billed at the agreed-upon rate and subject to the Rescheduling and Tardy Policy.
Relationship to Standard Terms: Unless specifically amended herein, all other provisions of these Terms & Conditions apply to Larger Contracted Engagements. In the event of conflict, the provisions of this section shall govern.
Clubs/Classes
Minimum Enrollment: Clubs require a minimum of three (3) enrolled students to run. If a club does not reach minimum enrollment, or does not run for any other reason, families will receive a full refund or, at the family's election, a credit toward another club, class, or tutoring.
Invoices & Payment: Families are invoiced at the time of booking. Payment must be made within fifteen (15) days of the invoice date to confirm and reserve the student's spot. If payment is not received within this period, the spot may be offered to another student.
Refund Policy: Club payments are non-refundable once paid, except where the club does not fill or does not run, or in the case of documented Sickness, Emergency, or Tutor Fault. If Teton Tutors L3C or the tutor is unable to deliver the club as scheduled, affected families will receive a proportional refund or credit.
Missed Sessions: Parent/Guardian and student absences, including for travel or scheduling conflicts, will not be refunded, credited, or rescheduled.
Receive Bills by Text Message
By providing your mobile phone number, you consent to receive billing statements, payment reminders, and other billing-related information from Teton Tutors L3C via text message.
Text message frequency will depend on your billing cycle and account status. Standard messaging and data rates may apply.
You may opt out of receiving text messages at any time by replying "STOP" to any message or by contacting us via email.
Opting out of text messages may impact your ability to receive billing information in a timely manner.
Teton Tutors L3C is not responsible for delays in receiving text messages due to technical issues, service interruptions, or factors beyond our control.
ACH Payments
By signing up for ACH payments, the client gives permission for Teton Tutors L3C to automatically process monthly payments per each monthly invoice.
When Teton Tutors Cannot Deliver
If a tutor or club leader arrives late, any lost time will be made up by extending or rescheduling the session by mutual agreement. Lost or made-up time due to late arrival will not be billed to the client.
Lessons or club sessions canceled by a tutor or leader due to illness or emergency will be communicated as early as possible. Such cancellations will not be charged to the client, and will be rescheduled or refunded at the discretion of Teton Tutors L3C.
Parent/Guardian Responsibilities
The signer of this Contract warrants they are a parent and/or legal guardian of the student and that they have the lawful authority to enter this Contract on behalf of the student.
Parent/Guardian will ensure their child attends tutoring sessions on time.
Parent/Guardian will ensure their child completes their weekly scheduled work.
Parent/Guardian will notify the tutor of pending schedule changes, such as trips, at least two weeks in advance.
Parent/Guardian will notify the tutor of cancellations or schedule changes due to Emergency or Sickness as early as possible.
Parent/Guardian has the sole responsibility to ensure that the student and tutor are meeting at a location that is safe, supervised, and suitable for tutoring services. This provision does not apply to sessions or programs held at a Teton Tutors or RadAcad location, or to off-site activities organized by Teton Tutors L3C.
Parent/Guardian shall immediately notify Teton Tutors L3C if the Parent/Guardian has any concerns about the services, actions, or suitability of the tutor.
Standard Sessions: Hours requested and confirmed by phone, text, email, calendar invite, or verbally are binding commitments and will be billed at the applicable rate, subject to the Rescheduling and Tardy Policy.
Larger Contracted Engagements: Hours are binding only when confirmed in writing (email, text, calendar invite).
Conduct and Dismissal
Students enrolled in RadAcad programs are governed by the Radical Minds Academy Code of Conduct, provided with enrollment documents and incorporated into this Contract by reference. The Code of Conduct sets out expected behaviors and a tiered set of responses to infractions, ranging from coach reminders to immediate expulsion.
Students receiving tutoring outside a Membership are expected to treat their tutor and the space with respect and to follow reasonable direction from staff.
Where a concern arises, Teton Tutors L3C will ordinarily contact the Parent/Guardian to discuss it and agree on a plan before taking further action, except where the Code of Conduct provides otherwise.
Teton Tutors L3C reserves the right to suspend, withdraw, or dismiss a student from any program, including Memberships, Clubs, and Classes, for disciplinary reasons, or where the Parent/Guardian's conduct makes continued service unworkable.
In the event of dismissal, membership fees for the current month will not be prorated or refunded. Prepaid amounts covering months after the month of dismissal will be refunded at the undiscounted rate, except where dismissal follows an Extreme Infraction as defined in the Code of Conduct, in which case no refund is owed.
Rescheduling and Tardy Policy
No-shows, cancellations, and rescheduling within 24 hours of the scheduled session will be charged in full to the client, and tutors will be paid in full.
Time lost due to tardiness on the part of the student or Parent/Guardian, and not communicated at least 24 hours ahead of time, will be charged in full to the client.
Cancellations within 24 hours due to documented Sickness or Emergency will be rescheduled at no charge where scheduling allows, at the discretion of Teton Tutors L3C.
Summer sessions. For the purposes of this policy, summer runs from June 15 through August 31. Sessions scheduled during that period require fifteen (15) days' notice to cancel or reschedule, in place of the 24-hour notice that applies during the school year. Summer sessions canceled or rescheduled with less than fifteen (15) days' notice will be charged in full, and tutors will be paid in full. The Sickness and Emergency exception above applies to summer sessions as well.
For avoidance of doubt, the 24-hour rescheduling policy does not apply to Memberships, Larger Contracted Engagements, or Clubs & Classes, which are governed by their respective terms.
Photo and Media Release
I give permission for my child's photo, video, or likeness to be used by Teton Tutors L3C and Radical Minds Academy for educational, promotional, or marketing purposes. This includes use on the company's website, social media, printed materials, and other public forums.
I understand that my child's name will not be used in association with their image without additional consent.
I will contact Teton Tutors L3C directly if I do not consent. Permission may be withdrawn at any time in writing, and Teton Tutors L3C will remove the student from materials it controls going forward.
Off-Site Activities and Transportation
RadAcad programs include off-site activities such as physical education at the Teton County Parks & Recreation Center, seasonal field trips, and recreational activities including skiing, rock climbing, and snowmobiling.
Participation in these activities requires a signed Parental Consent and Authorization Form. That form governs consent to participate, consent to transportation, emergency medical authorization, and acknowledgment of risk, and is incorporated into this Contract by reference.
The Parent/Guardian is responsible for providing any equipment the activity requires, including ski passes and personal gear, and for ensuring the student is fit to participate.
Staff may transport students to and from activities in personal vehicles where the Parental Consent and Authorization Form permits it.
Students may only leave a RadAcad location with Parent/Guardian confirmation. The Parent/Guardian may give standing permission or leave departure decisions to coach discretion.
Where a student does not arrive at a RadAcad location, Teton Tutors L3C cannot take responsibility for that student that day.
Other Considerations
These Terms & Conditions supersede all prior agreements between Teton Tutors L3C and the Parent/Guardian, and take effect on the date published.
This Contract shall be governed by the laws of the State of Wyoming, and the Ninth Judicial District Courts of Teton County, Wyoming, shall be the exclusive jurisdiction and venue for any disputes arising out of or related to this Contract.
No Warranties
Teton Tutors L3C and all Subcontracted Tutors make no promises or warranties with regard to a student's performance as a result of any tutoring provided.
Termination
Teton Tutors L3C may terminate this contract at any time with immediate effect for material breach, non-payment, or other business reasons. In such cases, any prepaid but unused amounts will be refunded, except as otherwise provided in the Memberships and Clubs/Classes sections, and unless termination results from Parent/Guardian breach.
Minors
Where the student is a legal minor, the Parent/Guardian shall enter into this tutoring contract on behalf of the student and shall accept and agree to all the terms and conditions contained herein on behalf of the student.
Parent/Guardian Liability Waiver and Release
I, the Parent/Guardian, hereby acknowledge and accept that Teton Tutors L3C contracts with independent Subcontracted Tutors, that Teton Tutors L3C has no respondeat superior liability or any other liability for the actions of a Subcontracted Tutor, and that I knowingly and voluntarily waive and release Teton Tutors L3C from any and all liability for the harms, damages, losses, and injuries caused to any person by a Subcontracted Tutor, Owner, Employee or person acting on behalf of Teton Tutors L3C.
I, individually, and on behalf of my spouse, minor child(ren), and our respective heirs, successors, assigns, and personal representatives, hereby release, waive, acquit, and forever discharge Teton Tutors L3C and its agents, owners, officers, trustees and representatives (in their official and individual capacities) from any and all liability whatsoever for any and all damages, losses, or injuries, including death, mental anguish or emotional distress to my child and/or property, including but not limited to any claims, demands, actions, causes of action, damages, costs, expenses (including hospital and medical expenses) and attorneys' fees, which arise out of, occur during, result from, or relate to the tutoring services, or the acts, errors, omissions of Subcontracted Tutors, including travel to and from locations, and including without limitation, any loss, claim, demand or suit that my child might assert once he/she attains the age of majority.
In addition to immediately contacting the Parent/Guardian and "Emergency Contact Person" as listed on the initial application, in the event of a medical emergency, I give unlimited permission to Teton Tutors L3C and its Subcontracted Tutors to call 911 and/or administer appropriate primary medical attention to my child/children in the event of any accident, illness, or injury, as needed. I will be responsible for any and all costs of medical coverage and treatment not covered by my personal insurance. I acknowledge and signify that I have read and understand this waiver and I sign it voluntarily. I acknowledge that I am the Parent/Guardian for the student listed on this form and have completed this form for adequate and comprehensive considerations entirely intending to be bound by same.
I, individually, and on behalf of my spouse, minor child(ren), and our respective heirs, successors, assigns and personal representatives, hereby agree to indemnify, defend and hold harmless Teton Tutors L3C and its agents, owners, officers, trustees and representatives (in their official and individual capacities) from any and all liability, loss or damage they or any of them incur or sustain as a result of any claims, demands, actions, causes of action judgments, costs or expenses, including attorneys' fees, which result from or relate to the tutoring services, or the acts, errors, or omissions of Subcontracted Tutors, or the enforcement of this Contract.
I hereby acknowledge and accept that there are certain risks, known and unknown, including bodily injury and death that could result from my child's involvement with the tutoring services. I have knowingly and voluntarily decided to assume the risks of these inherent dangers in consideration of Teton Tutors L3C's permission to allow my minor child to participate in the aforementioned program. I, individually and on behalf of my minor child, hereby release and discharge Teton Tutors L3C, and its agents, owners, officers, trustees and representatives (in their official and individual capacities) from any and all negligence, including Teton Tutors L3C's own negligence, in connection with my child's attendance at, or participation in the program, including travel to and from locations, except for gross negligence or willful and wanton misconduct on the part of Teton Tutors L3C.
In signing this Parent/Guardian Liability Waiver and Release, I hereby acknowledge and represent that I have read this entire document, that I understand its terms and provisions, that I understand it affects my legal rights and those of my child (or children), that it is a binding contract, and that I have signed it knowingly and voluntarily.
I agree that this Parent/Guardian Liability Waiver and Release is intended to be as broad and inclusive as permitted by the laws of the State of Wyoming. In the event that any provision contained within this Parent/Guardian Liability Waiver and Release shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this Contract shall be determined to be unlawful or otherwise unenforceable, the remainder of this Contract shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If a court should find that any provision of this Contract is invalid or unenforceable, and that by limiting said provision this Contract would become valid and enforceable, then said provision shall be limited to give full effect to the intent of this Contract.
All terms of this Parent/Guardian Liability Waiver and Release shall survive termination of the tutoring services and the termination of any other contract entered between Teton Tutors L3C and the Parent/Guardian.
Non-Solicitation
For the term of services and for two (2) years following the last date of service, Parent/Guardian may not solicit tutoring, educational consulting, youth enrichment activity, nannying, or babysitting from any Contractor of Teton Tutors L3C whose interaction with Parent/Guardian originated from Teton Tutors L3C. If Parent/Guardian nevertheless engages such individual, Parent/Guardian agrees to pay a placement/buyout fee of $3,000 as liquidated damages.
Intellectual Property
All materials created or provided by Teton Tutors L3C, Garrett Austen, or subcontracted tutors in connection with the services — including curriculum, worksheets, organizers, outlines, media, forms, data, and software, together with all copyrights and other proprietary rights in them — belong solely to Teton Tutors L3C and Garrett Austen. Enrollment grants no ownership interest in any of it.
These materials are provided for the enrolled student's own educational use. You may not copy, publish, distribute, adapt, sell, or create derivative works from them, in whole or in part, without written permission. Unauthorized use may be a breach of this Contract and may be addressed by injunctive or other equitable relief.
Privacy Policy

When you inquire about tutoring services or apply, we may collect the following types of personal information:
Contact Information (name, email address, phone number, mailing address)
Student Information (student name, age, grade level, academic needs)
Educational History (grades, transcripts, teacher feedback, IEP or 504 plans, if voluntarily provided)
Health and Emergency Information (allergies, medical conditions, accommodations, medications, physician and insurance details, and emergency contacts), collected for enrolled students so that we can respond appropriately in an emergency
Service Preferences (subject areas, scheduling availability, location preferences)
Payment Information (billing address, payment method, and phone number, which may be used for billing communication)
We may also collect information through cookies if you visit our website, to improve your browsing experience.
Student information. Most of the information above concerns a minor. We collect it from the Parent/Guardian, not from the student, and we use it only to deliver services to that student. Access is limited to the staff working with that student and to administrative staff who need it to schedule or bill. We do not use student information for advertising, and we do not disclose it to anyone outside Teton Tutors L3C except as described below or with Parent/Guardian permission.
We use your information solely for the purpose of:
Responding to inquiries and applications
Matching students with appropriate tutors
Managing scheduling and communication
Processing billing and payments (including contacting you by phone if needed)
Improving our services
Sending relevant updates, promotions, or information related to Teton Tutors L3C offerings
We do not sell or share your personal information with third parties for marketing purposes.
We take appropriate measures to protect your personal data from unauthorized access, alteration, disclosure, or destruction. These measures include:
Secure databases and cloud-based services
Password-protected devices
Limiting access to staff with a legitimate need to know
We may use third-party platforms to manage communication, scheduling, or payments (e.g., Mailchimp, Stripe, Google Workspace, Airtable, Teachworks). These providers have their own privacy policies. We select established providers and review their privacy practices, but we do not control how they operate.
Where a family enrolls through one of our partner schools or programs, we share the information that school needs to enroll and serve the student. We will tell you what is being shared before we send it.
You may unsubscribe from marketing emails at any time using the link in any email, or by contacting us. Unsubscribing does not stop billing or scheduling messages, which are necessary to deliver services.
You have the right to:
Access the information we have about you
Request corrections to your data
Request deletion of your data at any time (unless legally required to retain it)
We keep student and family records for five (5) years after a family's last date of service, after which they are deleted. Billing records are kept as long as tax and accounting rules require.
